National Conference on the Prevention and Management of State Litigation

The National conference on the prevention and management of government litigation, organized by the Ministry of Economy and Finance (the Kingdom's Judicial Agency) and held under the theme “A lever for the preservation of legality, the stability of investment and the rationalization of public expenditure”, kicked off this Tuesday, April 15, 2025 in Rabat. The aim of this major event is to strengthen strategic thinking on mechanisms for preventing legal risks and efficiently managing litigation involving the State and its branches, with a view to good governance, legal certainty and administrative performance.

​The inaugural session was attended by several high-ranking institutional figures, including the Minister of Economy and Finance, the delegate minister in charge of the Budget, the First President of the Supreme Council of the Judiciary, the Secretary General of the Supreme Council of the Judiciary, the Secretary General of the Ministry of Justice, as well as the Judicial Agent of the Kingdom.

In their speeches, the officials unanimously emphasized the need to strengthen the prevention of litigation involving the State and its entities, as a strategic pillar of public action modernization. They also stressed the importance of professionalizing litigation management, with a view to protecting public funds, securing investment projects, and improving services provided to citizens and the administration’s partners.

This conference is part of a national dynamic of reform and administrative efficiency, aiming to establish preventive legal governance, better anticipate litigation risks, and promote enhanced coordination among the various concerned public stakeholders.

The inaugural session was also marked by the signing of the Charter establishing the Network for Cooperation and Coordination in Litigation Management, concluded between the Judicial Agency of the Kingdom, the Ministry of Interior, the Ministry of Justice, the Ministry of Equipment and Water, as well as the Ministry of National Education, Preschool and Sports.

This initiative aims to strengthen coordination mechanisms in defending the State’s interests before national courts and arbitration bodies, to develop joint programs for prevention and enhancement of legal capacities, and to establish a strategic monitoring system for litigation risks.

The Charter notably provides for the creation of a digital platform dedicated to the centralization and monitoring of data related to litigation involving the State, thereby offering a decision-making and strategic management tool.

The best practices and results derived from this Network will gradually be extended to all ministerial departments and public institutions, through the progressive expansion of its membership list, in a spirit of harmonization, pooling of expertise, and collective upskilling of the administration.

In the same spirit, a partnership agreement was signed between the Judicial Agency of the Kingdom and the National School of Public Administration, with the aim of implementing cooperation programs in the areas of continuing education and capacity building for public administrations in litigation management.

The proceedings of the Conference are attended by all relevant stakeholders, including ministerial departments, local authorities, public institutions and enterprises, as well as representatives of the judiciary, Parliament, certain constitutional institutions, and the legal profession. This broad mobilization aims to lead to the development of concrete recommendations that will serve as the foundation for a new vision and an integrated national strategy for the prevention and management of State litigation.

The Conference proceedings will continue over two days, with the participation of experts and senior officials from Morocco, France, Spain, Senegal, Egypt, and the United Kingdom. This forum for exchange will allow for an in-depth examination of the issues raised through four plenary sessions and four thematic workshops, structured around the following key areas:

  • The foundations of a national strategy for the prevention and management of State litigation;
  • The anticipation of legal and financial risks as a lever for good governance, preservation of legitimacy, and protection of public service users’ rights;
  • The adaptation of the legal framework to strengthen the effectiveness of State litigation management, prevent disputes, and safeguard public funds;
  • The handling of investment-related litigation and the use of alternative dispute resolution methods.
  • The role of governance and digital transformation in optimizing litigation management and preventing disputes;
  • Challenges relating to land disputes, the enforcement of legal decisions and the recovery of public funds.
