On the sidelines of the National Conference on the Management and Prevention of State Litigation, organized by the Ministry of Economy and Finance (Judicial Agency of the Kingdom) on April 15 and 16, 2025, in Rabat, under the theme: “Prevention and management of State litigation, a lever for preserving legitimacy, investment stability, and rationalization of public spending”, and within the framework of establishing a platform for cooperation, coordination, and exchange of expertise in the field of management and prevention of State litigation — particularly regarding the unification of strategic vision, strengthening of training, legal monitoring, prevention, and risk management — a Pact of the Network for Cooperation and Coordination in State Litigation Management and Prevention was signed between the Judicial Agency of the Kingdom and the following partners:
• The Ministry of Interior;
• The Ministry of Justice;
• The Ministry of Equipment and Water;
• The Ministry of National Education, Preschool, and Sports.
By virtue of this pact, a network for coordination and cooperation will be established, bringing together the signatory parties as the most significant sectors in terms of the number and nature of litigations. This network will gradually be expanded to include other public administrations, thereby helping to generalize the successes achieved.
The signatory parties commit to coordinating and cooperating among themselves to defend the interests of the State before national courts and arbitration bodies, in accordance with the requirements of the public interest and in compliance with the principles of good governance, particularly through the use of alternative dispute resolution methods.
This cooperation notably includes a number of measures, among which:
• Prior coordination regarding the legal and judicial procedures to be followed in the management of disputes.
• Ensuring the exchange of all necessary information and documents to guarantee legal defense before the Kingdom’s courts.
• Efforts to strengthen and streamline the use of alternative dispute resolution methods by creating a special commission responsible for handling disputes submitted to it before the initiation of judicial proceedings.
• The exchange of memorandums, guiding circulars, and practical manuals related to dispute management.
• The establishment of a platform to centralize and monitor data related to State disputes, along with other measures aimed at unifying the strategic vision regarding litigation management.
